SomaBox Terms and Conditions for Enrolment

1. Acceptance of Terms

By enrolling in any SomaBox programme, you confirm that you have read, understood and agreed to be bound by these Terms and Conditions.

Acceptance of these Terms is required before completing enrolment and making payment through our platform.

2. Programme Structure and Participation

All SomaBox programmes are live, instructor-led experiences and are not self-paced.

By enrolling, you agree to:

  • Attend scheduled sessions as communicated

  • Actively participate in programme activities and discussions

  • Apply learning within your workplace where applicable

SomaBox does not guarantee specific business, career or performance outcomes, as results depend on individual effort, context and implementation.

3. Enrolment and Deadlines

All enrolments are subject to stated deadlines.

  • Enrolment closes once the deadline has passed or when capacity is reached

  • Late enrolment is not guaranteed

  • If you miss an enrolment deadline, you are encouraged to contact us directly to explore alternative options

4. Fees and Payment

Programme fees must be paid in full or in agreed instalments before participation.

We accept payments via:

  • Paystack (card and online payments)

  • Electronic Funds Transfer (EFT)

  • Mobile money

Where payments are processed through Paystack, you agree to be bound by Paystack’s own terms and conditions in addition to ours.

SomaBox is not responsible for:

  • Payment failures caused by third-party platforms

  • Delays in processing by banks or payment providers

5. Refunds and Cancellations

All payments are generally non-refundable, except at SomaBox’s sole discretion.

  • Requests for cancellations must be made in writing

  • Where refunds are approved, administrative fees may apply

  • Failure to attend sessions does not qualify for a refund

SomaBox reserves the right to reschedule programmes where necessary. In such cases, participants will be notified in advance.

6. Coaching and Programme Fit

SomaBox assigns facilitators, trainers or coaches based on participant needs and programme requirements.

While we aim to ensure strong alignment:

  • Participants may request a review of fit

  • Adjustments may be made at SomaBox’s discretion

7. Intellectual Property

All programme materials, frameworks, tools and content are the intellectual property of SomaBox unless otherwise stated.

Participants agree:

  • Not to reproduce, distribute or share materials without written consent

  • To use materials solely for personal or organisational application

8. Confidentiality

Participants agree to:

  • Respect the confidentiality of other participants

  • Not disclose shared experiences, discussions or sensitive information outside the programme

SomaBox will also take reasonable steps to maintain confidentiality, except where disclosure is required by law.

9. Data Protection and Privacy

By enrolling, you consent to the collection and processing of your personal data, including:

  • Name

  • Email address

  • Phone number

  • Organisation and job title, or

  • Any other required information

This data is used for:

  • Programme administration

  • Communication

  • Service improvement

SomaBox processes personal data in accordance with the Kenya Data Protection Act.

We will not sell or unlawfully share your personal data with third parties.

10. Limitation of Liability

To the fullest extent permitted under Kenyan law, SomaBox shall not be liable for:

  • Any indirect, incidental or consequential damages

  • Loss of business, revenue or opportunity

  • Outcomes resulting from the application or non-application of programme content

Participation in the programme is at your own discretion and risk.

11. Indemnity

You agree to indemnify and hold SomaBox harmless against any claims, losses, damages or liabilities arising from:

  • Your participation in the programme

  • Your use or misuse of programme materials

  • Any breach of these Terms and Conditions

12. Code of Conduct

SomaBox maintains a professional and respectful learning environment.

We reserve the right to remove any participant from a programme without refund if they:

  • Engage in disruptive, inappropriate or unethical behaviour

  • Violate confidentiality or intellectual property terms

13. Amendments

SomaBox reserves the right to update these Terms and Conditions at any time.

Updated terms will be communicated via our platform or email and will take effect immediately upon publication.

14. Governing Law

These Terms and Conditions are governed by the laws of the Kenya.

Any disputes arising shall be subject to the jurisdiction of Kenyan courts.
